1. Data controller

In compliance with Regulation (EU) 2016/679 (GDPR) and the Spanish Organic Law 3/2018 on Personal Data Protection and digital rights guarantee (LOPDGDD), we inform you about the processing of personal data we collect through the Site.

2. Data we process

Through the contact form we collect the following data:

  • Name
  • Email
  • Company (optional)
  • Service of interest (optional)
  • Inquiry message

We do not process special categories of data (racial origin, political opinions, health, etc.). We do not request information from minors.

3. Purpose of processing

We process the data to:

  • Manage and respond to inquiries received through the contact form.
  • Maintain the necessary communication during the pre-contractual and, where appropriate, contractual phase.
  • Comply with applicable legal obligations.

4. Legal basis

The basis legitimizing the processing of your data is:

  • Consent of the user when submitting the contact form (Art. 6.1.a GDPR).
  • Legitimate interest to respond to and manage the request (Art. 6.1.f GDPR).
  • Compliance with legal obligations where applicable (Art. 6.1.c GDPR).

5. Retention period

Data will be kept for the time necessary to attend to your inquiry. If a contractual relationship begins, for the duration of the relationship and the periods legally required to respond to potential liabilities. After that time, the data will be deleted.

6. Recipients and processors

We do not transfer your data to third parties, except by legal obligation. However, we have providers acting as data processors who access the data to provide their services:

7. International transfers

The indicated providers may involve data transfers to the United States. These transfers are made under the EU-U.S. Data Privacy Framework and/or standard contractual clauses approved by the European Commission, which guarantee an adequate level of protection of personal data.

8. Your rights

As the data subject, you have the right to:

  • Access — to know what data we process about you.
  • Rectification — to correct inaccurate or incomplete data.
  • Erasure (“right to be forgotten”) — to delete your data when it is no longer necessary.
  • Objection — to object to processing on legitimate grounds.
  • Restriction — to ask us to restrict processing while a complaint is resolved.
  • Portability — to receive your data in a structured, commonly used format.
  • Withdraw consent at any time, without affecting the lawfulness of prior processing.

You can exercise these rights by emailing upgraders.contact@gmail.com indicating the right you wish to exercise and attaching a copy of your ID or equivalent document proving your identity.

9. Complaint to the supervisory authority

If you consider that the processing of your data does not comply with the regulations, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD), at C/ Jorge Juan, 6, 28001 Madrid, or through www.aepd.es.

10. Automated decisions

We do not make automated decisions, including profiling, that produce legal effects on users or significantly affect them.

11. Changes to this policy

We may update this policy to adapt it to legislative changes or changes in our services. We recommend reviewing it periodically. The date of last update appears at the top of this page.
