1. Acceptance

These terms regulate access to and use of the upgraders.com website (hereinafter, “the Site”), owned by UPGRADERS. Access to the Site implies full acceptance of these conditions. If you do not agree with any of them, please do not use the Site.

2. Service purpose

UPGRADERS is an agency that provides web design and development, automation, enterprise software and process consulting services. Through the Site we provide information about our services, case studies and a contact form to start a conversation.

The scope, deadlines and economic conditions of any project will be subject to a specific quote and contract, which will prevail over the provisions of these terms.

3. User obligations

The user agrees to:

• Make lawful use of the Site, in accordance with the law, morality, public order and these terms.
• Not use the Site for fraudulent purposes or engage in conduct that violates the rights of third parties.
• Provide truthful, accurate and updated information in the contact form.
• Not introduce, distribute or disseminate content that is contrary to current law, fundamental rights or public order.
• Not perform actions that may damage, overload, deteriorate or disable the Site or its services.

4. Intellectual property

All the contents of the Site (texts, images, designs, logos, source code and other elements) are owned by UPGRADERS or by third parties who have authorized their use. Access to the Site does not grant the user any intellectual or industrial property right over them. Reproduction, distribution or transformation of the contents without prior written authorization is prohibited.

5. Contact form and personal data

The Site includes a contact form that collects name, email and, optionally, company and service of interest, with the sole purpose of managing your request and getting in touch with you.

The data is not transferred to third parties and is kept for the time necessary to attend to the inquiry and, where appropriate, to comply with legal obligations.

The user may exercise their rights of access, rectification, deletion, opposition, limitation of processing and portability by writing to upgraders.contact@gmail.com.

6. Service availability

UPGRADERS will make its best efforts to keep the Site operational, but does not guarantee continuous availability and may interrupt it for maintenance, updates or force majeure without giving rise to any compensation.

7. Limitation of liability

UPGRADERS will not be liable for direct or indirect damages arising from the use of the Site or the inability to access it, except in cases where the law imposes liability imperatively.

8. Modifications

UPGRADERS reserves the right to modify these terms at any time. Modifications will be effective from their publication on the Site. Users are advised to review them periodically.

9. Applicable law and jurisdiction

These terms are governed by Spanish law. For any dispute that may arise, the parties submit to the Courts of the owner's domicile, expressly waiving any other jurisdiction that may correspond to them.
